Terms and Conditions for Supply
01. Price & Inco terms: All prices are in currency mentioned in Quote. Price is valid for the Quantity, If Quantity varies, Price will change. Products are to be ordered in multiples of SPQs and MOQs where ever applicable. Price terms will be Ex-works RARE Enterprises, Bangalore, India. P & F Extra at actual.
02. Local Taxes: GST as applicable for the particular line item at the time of shipment.
03. Payment Terms: 100% Advance by Cheque / DD / Account Transfer, against our Proforma Invoice.
04. Purchase Order Condition: All Purchase Orders to RARE Enterprises, Bangalore shall be NCNR [Non-Cancel able and Non-Returnable.] All products are special buys against your specific orders and must be shipped as per agreed delivery schedules.
05. Validity of Quote: This Quote is valid for 7 days from date of quote. If currency fluctuation is in excess of 3%, RARE Enterprise, Bangalore, reserves the right to re-negotiate the pricing. Current Conversion refer www.xe.com .
06. Product Availability: All products are available as per the lead time mentioned in the Quotes. All products are subject to prior sales. Our PI confirms availability of parts and will be held for time mentioned in PI until payment.
07. Delivery: As mentioned in Quote from the date of receipt of Payment in our bank. Quoted lead times may be adjusted based on order quantity and inventory at time of purchase order. Delivery period starts after full payment to our account. Delivery date to be calculated as per working days in running week, taking care all National Holidays of India and shipping country port. Delivery confirmation is subject to confirmation from the supplier as case may be, after loading of purchase order on supplier.
08. Country of Origin: USA/ Europe / HONG KONG / TAIWAN / KOREA / Respective manufacturer Location.
09. Products & Testing: Products supplied will be as per Manufacturers Specifications OR as per mutually agreed specifications. Always test the parts supplied individually as per the data sheet or agreed specification. Products must not be tinned or soldered or programmed before testing for quality to assure form, fit and functionality. Warranty will not be applicable if products are not tested individually. Use correct ESD handling and Temperature controlled equipments for Testing and mounting. User shall ascertain by full electrical testing of the parts individually for suitability of use on their product, before mounting on your product.
10. Warranty & Period:One Month from date of Invoice, unless otherwise mentioned explicitly differently in our Quotation. Scope of warranty is limited only to the extent of value of the goods, no other liability is applicable, nor it should be imbibed or assumed by customer.
11. Warranty Coverage limitation: All products are Guaranteed to be 100% Genuine and New, form fit and function guarantee for 30days. Products found defective upon inspection of Material for any reason will be replaced at no extra cost or the value of the goods will be refunded. Replacement will be subject to availability. Replacement or Refund is applicable only for unused, un-soldered parts which are in our original packing with all labels intact without any extra markings on the parts or packages. A full official Test Report / Failure Analysis Report from an Independent Test Lab are must for all replacement or refund. Test Report of component required not your product test report. Replacement or refund will be made after approval of rejection as per instructions provided in RMA ( Return Merchandise Authorization ).
12. Scope of Warranty: This Warranty is expressly in lieu of and excludes all other express or implied warranties, including but not limited to warranties of merchant-ability and of fitness for intended purpose, use of application and all other obligations or liabilities on the part of seller, unless other such warranties, obligations or liabilities are expressly agreed to in writing by seller.
13. Rejection / Shortage:Customer shall communicate to RARE Enterprises in writing on any discrepancies with respect to Quantity, Packing or damages of products supplied, within 7 days from the date of Invoice. Information details should accompany photos for any packing or transit damages.
In the event of any rejection claims for any reason what so ever, the same has to be communicated within 30 days from date of shipment, A full official Test Report / Failure Analysis Report from an Independent Test Lab along with customer rejection report specifying reason for rejection. Customer Rejection report shall contain test method, tested parameters as per the data sheet. In the case of rejection, A full official Test Report / Failure Analysis Report from an Independent Test Lab to be given along with few samples for evaluation and analysis sent along with the rejection reports. In the event this is not reported within 30 days of shipment, any request received thereafter will not be entertained.
14. NON-Conforming Product Handling: In the event a rejection is approved, an RMA number will be issued along with instructions. The rejected material must be returned, to be received at the respective office within the expiry date. Failing which RARE Enterprises will not be obliged to accept the rejection or entertain any claim/refund or to replace the parts. RMA is generated by us when ever parts are found non conforming with respect to data sheet upon our testing. RMA will contain all instructions for return which shall be strictly followed by customer
15. Technical Support: Not available for this product.
16. Installation Support: Always test the parts before mounting on the board for vital parameters as per data sheet. Use correct ESD handling and Temperature controlled equipment s for mounting.
17. Documentation: Documents provided along with the shipment are Commercial Invoice.
18. Governing Law: This Order shall be construed and interpreted in accordance with the laws of Bangalore, India.
19. Any other Terms & Conditions: No other condition affecting / having financial implications is acceptable to RARE Enterprises, Bangalore other than the above. Release of Purchase Order confirms that the customer has explicitly accepted all the above conditions without any deviation and has released the Purchase Order.
